Licence to Disturb Otters or their Breeding or Resting Places
What is this licence?
Otters are listed on Annex IV of the EU Habitats Directive. It gives strict protection to otters and their breeding and resting places. This applies even if you have planning permission.
Article 16 of the Habitats Directive provides for derogations. This licence allows activities which could disturb otters or their breeding place. It may be issued "provided there is no satisfactory alternative, and the derogation is not detrimental to the maintenance of the populations of the species concerned at a favourable conservation status".
