What is this consent?

This is a special planning application for large scale projects in specific sectors (eg. energy). These are known as strategic infrastructure developments (SID). It allows an application to be made directly to An Coimisiún Pleanála (ACP), rather than a local authority. ACP do not issue licences but grant or approve planning applications.

Developments can also include projects that:

  • Contribute significantly to meeting any of the National Planning Framework objectives
  • Contribute significantly to meeting any regional, spatial and economic strategies for an area
  • Have a significant effect on the area of more than one planning authority
  • Produce a higher energy output than the scales relevant to local authorities

When do I need it?

Apply for this consent during the planning phase of your project. This will be after your design is completed and following confirmation by An Coimisiún Pleanála that your project is a SID project. This pre-application confirmation must be obtained prior to lodging an application for consent.

How to apply

Pre-application consultations

You must enter into pre-application consultations with An Coimisiún Pleanála if your project complies with the definition of a SID project. The pre-application process must be made in writing. The Board will give a decision on whether your project is classified as a strategic infrastructure development. From there, it can either:

  • Progress to application stage with An Coimisiún Pleanála
  • Not be classified as strategic infrastructure development and you can apply to the local authorities instead

Making your application

Once your project is determined to be a SID project, you must make your application directly to An Coimisiún Pleanála. Your application must be accompanied by an Environmental Impact Assessment Report (EIAR). There are some exceptions for electricity cases.

In some cases a Natura Impact Statement (NIS) may also be required, depending on specific circumstances.

What if my application is rejected?

There is no appeal process, the decision taken is considered to be final. Cases may be taken to the high courts for judicial review. This can be done within 8 weeks of the decision.
